Request to Launch Federal Investigation into TOH and Councilman Cuthbertson

Greater Huntington Civic Group announces its request to launch a Federal Investigation into the Town of Huntington and Councilman Mark Cuthbertson. The following is a letter dated October 13, 2014, sent to the United States District Attorney’s Office the Honorable Loretta E. Lynch and many other branches of government for investigation.

Dear Judge Lynch,

In light of the recent allegations made on October 4, 2014 by Newsday in two articles headlined “The Insiders” and “Huntington Councilman Mark Cuthbertson didn’t disclose ties to Gary Melius” (See attached), we the people of the Town of Huntington are respectful requesting a Federal Investigation into the allegations as well as a complete accounting and investigation into but not limited to the Town of Huntington Town Council and the Huntington Board of Ethics and Financial Disclosure.

This request is made due to the accusations that Cuthbertson has taken part in a scheme to use his political network to improperly collect receivership fees and expenses in part through the false filing of documentation with the courts. Furthermore he unethically and illegally failed to disclose personal and business relationships with Gary Melius (and others) while not recusing himself from votes regarding land use/zone changes for Melius and his businesses (and others).

The request to investigate the Town of Huntington Town Council and the Huntington Board of Ethics and Financial Disclosure is due to facts exposing the blurred lines between elected officials and those who are ethically in charge of keeping them aligned with our Town Governed laws while simultaneously being part of the collusion.  Several complaints of Councilman Mark Cuthbertson (and others) have been submitted over the years to the Ethics Board showing our elected to be in violation of AR Code of Ethics (§ 29-9)  yet the requests fall on deaf ears.

The same individuals who are appointed to the public’s trust to enforce the laws are guilty of breaking them (see attached). When political donations are made from Huntington Board of Ethics appointees to current standing elected officials we have a serious flaw in our system of checks and balances. It is no wonder 4 years of complaints have yielded nothing but larger political war chests for those they are supposed to be investigating.

In closing we are asking for a Full Investigation into specifically, but not limited to:

*Town of Huntington Councilman Mark Cuthbertson (Newsday allegations and attached)

*James Matthews, Attorney-currently seeking a Judgeship

*All parties names in the article “The Insiders”

*Huntington Town Board and all political donations in breach of AR Code of Ethics 29-9

*Huntington Board of Ethics and Financial Disclosure specifically Howard Glickenstein (see attached donations from Ethics Board – Huntington Board of Ethics and Financial Disclosure, appointees.)

*Huntington Board of Ethics and Financial Disclosure specifically Roger Ramme (see attached donations from Ethics Board – Huntington Board of Ethics and Financial Disclosure, appointees.)

    While I do not disagree with the request for an investigation as stated in the Greater Huntington Civic Group letter, I do object to the Group allegedly acting on behalf of the “people of the Town of Huntington”. At best the organization can only act on behalf of its membership. Perhaps the next time I will not agree with its position on a matter– So I must object. Like too many founders of these “civic” organizations, the founders forget the scope of their authority.

    It would be nice to get to the bottom of this. There has been far too much corruption in this town and it has to be stopped

    The occurrence of this pervasive corruption is disheartening, causing terrible distrust of community representatives who purport to represent their constituents’ interests, but are revealed to only care about lining their own pockets. What a disgrace, Councilman Cuthbertson. This is crying out for prosecution, hopefully on the federal level. This person should go to prison! This is a multi-facted fraud that generated a great deal of money for Cuthbertson. It doesn’t appear that he ever thought he would be exposed, given the support of equally duplicitous people like Jim Matthews. Head of the ethics board indeed. No way does he deserve to be a judge. All of this is very, very upsetting.
